1. The Bombay High Court, on Sunday, dismissed the plea of a 13-day-old unnamed girl concerning her right to stay on the Kavthevadi creek’s land.

2. The petitioner’s mother had filed the case for the girl, which challenged the state government’s decision to demolish the shanties in the creek they lived in.

3. After the demolition orders were passed by the government, slum dwellers had approached the Ghar Bachao Ghar Banao Andolan (GBGBA), which then filed a petition on behalf of the unnamed girl child. The petition argued that the mother and her child had been evicted unfairly.

4. While expressing its inability to accept the plea, the court stated that the slum couldn’t be allowed to exist any longer because the right to settle and reside doesn’t allow for permission to occupy government land. It also cited that the slum in the creek is unsafe to live in.

5. However, taking into consideration the plight of the homeless, the court has asked the state to provide them night shelter and other welfare schemes.
