Bombay HC vacates stay on cluster developments in Mumbai, to pave way for redevelopment
The Bombay High Court on Friday vacated its stay on cluster developments in Mumbai Metropolitan Region Development Authority (MMRDA) region.
The High Court vacated this stay after a report which stated that most of the people are unable to develop or rebuilt their premises due to financial reasons.
Maharashtra Chief Minister Devendra Fadnavis welcomed the HC decision, adding that it will pave way for the redevelopment of old and dilapidated buildings in Mumbai Metropolitan Region. The notification for the same is expected to be issued immediately.
“With the approval of Honorable High Court, the state government can speed up cluster redevelopment in Mumbai suburban,” he tweeted.
According to an earlier decision, the cluster redevelopment will be done in an area of 6000 sq mt and more.
“This will pave a way for planned development with availability of more public amenities, using the spaces more wisely. 30-year-old buildings would be covered in this redevelopment and 50 percent area of slum will also be included,” Fadnavis added.
The HC took the decision after taking cognisance of the state government’s impact assessment report.
In 2014, the Maharashtra Government had fixed a policy that developers in Mumbai, Thane and Navi Mumbai may get Floor Space Index (FSI) up to four for cluster development.
This decision was challenged in High Court through a Public-Interest Litigation (PIL) and all cluster development works were stayed by the Bombay High Court.
