Seize all 7 properties of underworld don Dawood Ibrahim in Mumbai: Supreme Court
The Supreme Court on Friday directed the Central Government to seize properties of underworld don Dawood Ibrahim in Mumbai.
The apex court bench headed by Justice RK Agrawal dismissed the plea filed by Ibrahim’s mother and sister, Amina Bi Kaskar and Haseena Parkar, challenging the decision of the Enforcement Directorate (ED) and other agencies to attach property owned by them in Mumbai as “proceeds of crime”.
Since both Kaskar and Parkar are no more, the petition was filed by their legal representatives. The lawyers alleged that the seizures were illegal as they had not been duly served with the forfeiture notices.
They had approached the apex court after the Delhi High Court had rejected their appeal to stop the taking over of their properties under the Smugglers And Foreign Exchange Manipulators (Forfeiture Of Property) Act (SAFEMA).
The seizures were related to seven properties in south Mumbai’s Nagpada – two of which are in Amina’s name while the remaining five were in the name of Hasina.
The properties earlier belonged to Dawood, but his mother and sister took possession of them after he fled the country two decades back.
The Central Government had earlier filed a detailed report before the court saying that the properties in Nagpada belonged to the don and had been acquired using “undeclared and ill-gotten income” from his criminal activities.
It also claimed that Kaskar and Parkar were given several opportunities to provide legal documents to prove that the properties were acquired through a legal source of income but they had failed to provide any documentation to support the claim,
Dawood is the boss of D-company and mastermind of 1993 Bombay blasts. The designated global terrorist is wanted for several crimes including murder, extortion, targeted killing, drug trafficking, and terrorism.
Although he is believed to be residing in Pakistan, his location is not confirmed.
